Terms of Service

These Terms of Service (“Terms”) govern your use of the HexZen mobile and web applications and any related services (collectively, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service (16 in the European Economic Area). By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. You also agree to provide accurate information, including your real name and a current email address.

2. Your account

You are responsible for everything that happens under your account, including keeping your password confidential and notifying us promptly if you suspect unauthorized access. We may suspend or terminate your account if you violate these Terms.

3. Acceptable use

You agree not to use the Service to:

• Harass, threaten, intimidate, dox, or impersonate any person.
• Post content that is unlawful, hateful, sexually explicit, or promotes violence against any group.
• Spam other users, run unsolicited commercial advertising, or repeatedly create games you have no intention of hosting.
• Scrape, mirror, or copy the Service or its contents without permission.
• Probe, attack, or interfere with the Service or attempt to bypass security or rate limits.
• Use the Service to organize unlawful activity, including unlicensed gambling.
• Submit content that infringes another person's intellectual property or privacy rights.

We reserve the right to remove content or accounts that violate these rules, with or without notice.

4. Games and hosts

HexZen is a directory and coordination tool. We do not organize games ourselves. When you host a game, you are responsible for:

• Securing the playing location and any required permits.
• The safety of attendees during the game, including providing first-aid supplies if you choose to.
• Communicating cancellations promptly through the in-app chat or cancel-game feature.
• Honoring any cost you set for the game and refunding players if you cancel.

HexZen is not a venue operator, league, or insurer. We do not employ hosts or players, and we do not verify field permits, court access, or skill claims. Participation in any pickup game is at your own risk.

5. Reliability score and reviews

Your reliability score is computed automatically from your attendance record. Reviews you receive from teammates are public on your profile and cannot be deleted by you. You may report reviews you believe violate these Terms; we will review them under our content moderation process and remove those that do.

6. Content you submit

You retain ownership of the content you submit (profile information, photos, chat messages, reviews). By submitting content you grant HexZen a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content for the purpose of operating and improving the Service.

You represent that you have the right to submit the content you post and that it does not infringe the rights of any third party.

7. Reporting and moderation

You may report users, messages, or games that violate these Terms from the corresponding screen in the app. We act on reports within 24 hours where reasonably possible. We do not promise a particular outcome and our moderation decisions are final.

8. DMCA and intellectual property

If you believe content on the Service infringes your copyright, send a notice to support@hexzen.app including: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the infringing material and its location on the Service; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized; and (f) a statement under penalty of perjury that the information is accurate and you are authorized to act for the rights holder.

9. Subscriptions and purchases

Certain features of the Service may require a paid subscription. When a subscription is offered, the price, billing period, and renewal terms will be presented at checkout. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. Cancellation takes effect at the end of the period; refunds for partial periods are not provided except where required by law. If you purchase through the App Store or Google Play, refunds are governed by those platforms' policies.

10. Termination

You may stop using the Service at any time and delete your account from the app. We may suspend or terminate your account if you violate these Terms or if we discontinue the Service. On termination, the rights and licenses granted to you under these Terms end immediately.

11. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, HexZen disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information about a game, location, or other user is accurate.

12. Limitation of liability

To the maximum extent permitted by law, HexZen and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any conduct or content of any other user, including any physical contact, injury, or property damage at a game; (c) any unauthorized access to or use of our servers; or (d) any other matter relating to the Service. In no event will our aggregate liability exceed the greater of one hundred US dollars (USD 100) or the amount you paid us in the twelve months preceding the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless HexZen and its affiliates from any claims, damages, liabilities, costs, and expenses arising out of your violation of these Terms, your content, or your use of the Service.

14. Dispute resolution; arbitration

Any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the seat of arbitration in Delaware. You and HexZen waive any right to bring a class action or to have claims heard by a jury. You may opt out of this arbitration agreement by emailing support@hexzen.app within 30 days of first accepting these Terms.

15. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Subject to the arbitration agreement above, exclusive venue for any non-arbitrable dispute lies in the state and federal courts of Delaware.

16. Changes to these Terms

We may revise these Terms from time to time. The current version will always be available on this page with a “Last updated” date. Material changes will be communicated in the app. Continued use of the Service after the effective date constitutes acceptance.
