End User License Agreement

This End User License Agreement (“EULA”) is a contract between you and HexZen governing your use of the HexZen mobile application (the “App”). By installing or using the App you agree to this EULA, our Terms of Service, and our Privacy Policy. If you do not agree, do not install or use the App.

1. License grant

HexZen grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use one copy of the App on any device that you own or control, solely for your personal, non-commercial use, and subject to this EULA.

2. Restrictions

You may not, and you may not permit any third party to:

  • Reverse engineer, decompile, or disassemble the App.
  • Modify, adapt, translate, or create derivative works based on the App.
  • Distribute, sell, lease, rent, lend, or sublicense the App.
  • Remove, alter, or obscure any proprietary notices on the App.
  • Use the App in violation of any law or these terms.

3. Auto-renewing subscriptions

Certain features of the App may be available only with a paid subscription. Subscription pricing and renewal terms are shown at purchase. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the period ends. You can manage and cancel subscriptions in your App Store or Google Play account settings. Refunds for partial billing periods are not provided except where required by law or by the platform's policy.

4. Updates

HexZen may provide updates, patches, and new versions of the App. Updates may be required to continue using the App. This EULA covers any update unless that update is accompanied by a separate license, in which case the separate license governs.

5. Third-party content and services

The App may include or link to third-party content and services (such as Google Maps, Apple Maps, and venue information). HexZen is not responsible for that content or those services and does not endorse them. Your use of third-party services is subject to their own terms.

6. Apple-specific terms (iOS users)

If you obtained the App from the Apple App Store, the following additional terms apply between you and Apple Inc.:

  • This EULA is between you and HexZen, not Apple. Apple is not responsible for the App or its content.
  • The license granted is limited to use of the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the App.
  • Apple is not responsible for any product warranties, whether express or implied. In the event of any failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the App's purchase price. Beyond that, Apple has no other warranty obligation regarding the App.
  • HexZen, not Apple, is responsible for addressing any claim relating to the App, including product liability claims and intellectual property claims.
  • Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and have the right to enforce its terms against you.

7. Google-specific terms (Android users)

If you obtained the App from Google Play, your use is also governed by the Google Play Terms of Service. Google is not a party to this EULA and is not responsible for the App.

8. Termination

This EULA terminates automatically if you fail to comply with its terms or if you delete the App from your device. On termination, you must stop using the App and destroy all copies in your possession.

9. Warranty disclaimer and liability

The App is provided “as is” without warranty of any kind. To the maximum extent permitted by law, HexZen disclaims all warranties and will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App. See the Terms of Service for the full liability framework and dispute-resolution clauses, which are incorporated by reference into this EULA.

10. Export controls

The App and any technology it contains are subject to US export control laws. You may not export, re-export, or transfer the App in violation of those laws.
